Florida Sales Tax Attorney

Regarding the Documentary Stamp Tax

In our state, documents that transfer interest in Florida real property, are assessed what is known as a "documentary stamp tax." This tax applies to warranty deeds, quit claim deeds and similar documents. This tax is also levied on other kinds of obligations to pay money which are executed, signed and delivered in our state. This would include mortgages, bonds, notes, liens and certain renewal notes.

As with most taxes, there are many rules and laws which regulate the various aspects of documentary stamp tax including how it is paid, by whom, the rate at which it is levied, and more. This can lead to confusion and controversy between individuals or businesses and the DOR which can be costly in terms of both time and money. Taxpayers of often surprised upon audit when they find out the hard way that documentary stamp taxes can apply to intercompany transactions and when businesses are bought/sold.

At the Law Offices of Moffa, Sutton, & Donnini, P.A., we focus our practice on successfully resolving tax situations once they have become difficult or when it appears they are heading in that direction. If you are a business owner (or CPA or attorney who is working with a client) who is running into troubles with documentary stamp tax issues, a knowledgeable Florida sales tax audit lawyer from our firm is ready to take hard-hitting actions on your behalf.

Helping You to Assist Your Clients

Any of the persons involved in a taxable transaction may be liable for the documentary stamp tax. Businesses are often surprised by the rule that if an individual or business has more than 5 taxable transactions per month, they must register with the Florida Department of Revnue. There is a limit of $2,450 in taxes due on notes and other written obligations but there is no tax limit in Florida tax law for filed liens or mortgages.
